This Privacy Policy describes how Athletic Gym Holdings LLC, doing business as RxFit Functional Health (“RxFit,” “we,” “us,” or “our”) collects, uses, and discloses information when you access or use our websites, portals, mobile applications, intake forms, and related services (collectively, the “Services”). It also explains the choices you may have regarding your information. By using the Services, you agree to the collection, use, and disclosure of information as described in this Privacy Policy. If you do not agree, do not use the Services.

Depending on the Services you use, we may receive information from independent laboratories, pharmacies, telehealth technology vendors, and licensed healthcare professionals involved in your care (for example, lab results, fulfillment status, or visit documentation). We may also receive information from you if you upload records or authorize us to obtain records from another person or organization.


4. How We Use Information

We use information for purposes such as:

- Providing, operating, and improving the Services (including account creation, identity verification, and customer support).

- Coordinating laboratory testing, results delivery, and care navigation.

- Facilitating telehealth visits and related clinical workflows (where applicable).

5. How We Disclose Information

A. Service Providers

We disclose information to Service Providers that help us operate the Services (for example, hosting, analytics, communications delivery, appointment scheduling, customer support, and payment processing). Service Providers are permitted to use information only to perform services for us and are required to implement reasonable confidentiality and security measures.

B. Laboratories, Pharmacies, and Healthcare Professionals

If you use Services involving laboratory testing, prescription facilitation, or clinical care, we disclose information as needed to coordinate those Services (for example, to a laboratory to process a test order, to a pharmacy to fulfill a prescription, or to a healthcare professional to provide care).

C. At Your Direction or With Your Consent

We may disclose information when you direct us to do so or provide consent (for example, if you request that we send results to another provider, family member, or other recipient).

D. Legal, Safety, and Compliance

We may disclose information if we believe in good faith that disclosure is necessary to comply with law, respond to lawful requests, protect rights and safety, investigate fraud or security issues, or enforce our terms and policies.

E. Business Transactions

We may create and use Deidentified Data for analytics, research, and business purposes. We may disclose Deidentified Data to others where permitted by law.


6. SMS/MMS and Mobile Messaging Privacy (A2P Required)

If you opt in to receive text messages (SMS/MMS) from RxFit, the following provisions apply in addition to the rest of this Privacy Policy.

A. Required Non‑Sharing Clause for Mobile Information

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

B. Messaging Vendors / Aggregators

Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the Text Message services. We may disclose limited information to our messaging platform providers, aggregators, and carriers solely to deliver and manage the messaging program (for example, to route messages and maintain suppression lists for opt-outs).

C. Opt-Out and Help

You can opt out of text messages at any time by replying STOP. For help, reply HELP or contact us at [email protected].


7. Cookies and Similar Technologies

We use cookies and similar technologies (such as pixels, SDKs, and local storage) to operate the Services, remember preferences, perform analytics, and measure the effectiveness of our communications. You can control cookies through your browser settings and, where available, cookie preference tools. If you disable cookies, some features may not function properly.


8. Your Choices

A. Marketing Emails

You can opt out of marketing emails by using the unsubscribe link in the email. You may still receive service-related communications.

B. Text Messages

If you opt in to receive text messages, you may opt out at any time by replying STOP.

C. Access, Correction, and Deletion Requests

The Services are not intended for individuals under 18. We do not knowingly collect Personal Information from children under 13. If you believe a child has provided information to us, contact us so we can take appropriate action.


13. Health Information and HIPAA

Certain health information may be subject to additional protections under federal and state health privacy laws. When clinical services are provided by licensed healthcare professionals, those professionals (or their medical entities) may provide you with a Notice of Privacy Practices describing how protected health information is used and disclosed. If a Notice of Privacy Practices applies to your care, it will control for protected health information to the extent required by law.


14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will post the updated Privacy Policy and update the Last Updated date. Your continued use of the Services after the effective date of an updated Privacy Policy indicates your acceptance of the updated policy.
